Overview of BIS Licence

BIS stands for Bureau of Indian Standards, an Indian National Standard Body established in 1986. It was created to harmonize the quality of consumer and industrial products being sold in India . BIS license on a product ensures its quality and that the product is as per the norms set by the Indian government to meet international quality standards.

BIS product certification ensures integrity, trustworthiness, and reliability of any product. To apply for BIS certification the applicant has to be a manufacturer, either of Indian or foreign origin. In some cases BIS registration certificate can be optional or mandatory depending upon the nature of the product and the scheme in which it lies.

Despite being optional in some cases, the government promotes it following reasons:

  • It protects the general public's health
  • It offers quality control at the manufacturer's end.
  • It safeguards consumers from dangerous goods
  • It increases consumer trust on the standard marked products.

Advantages of BIS certificate registration are as follows:

  • Ensures high levels of quality because goods with a BIS registration are produced per the Indian standards and are tested during the process.
  • If the products are BIS certified, it ensures that no harmful chemicals are being used in consumer products
  • Helps Indian manufacturers to export the product, due to their products being developed and tested at par with international standards.
  • Gives market edge over the manufacturers who are not certified.
  • Enables Foreign manufacturers to understand requirements of the Indian market and standards so that they can develop the products accordingly.

The 2 major BIS schemes under which most of the products fall are:

A.) BIS CRS registration which is mandatory on more than 80 products.
B.) ISI mark license for Indian and foreign manufactures which is mandatory on more than 380 products.

BIS registration online is the way through which Indian manufacturers can apply for the registration or license.
Note: 1.) In case of foreign manufacturer, for BIS new registration under the CRS scheme, the application has to be made from this website.
2.) BIS online registration is not applicable in case of ISI mark for the foreign manufacturers, the application has to be submitted in offline mode.

Documents Required for ISI mark license:

For online BIS registration of Indian manufacturers the following documents are a must:

  • GST certificate
  • MSME certificate ( if applicable )
  • List of machinery
  • List of raw materials
  • List of instruments in the in-house test laboratory.
  • Plant layout
  • Test report from BIS’ lab or OSL ( Outside privately owned laboratories appointed by BIS )
  • Calibration certificates,etc.

Documents Required for CRS registration:

  • GST certificate
  • Brand Declaration letter
  • Test report from BIS recognized laboratory.
  • Trademark declaration ( if any )
  • Applicable affidavits.
  • Applicable declarations,etc.

When the foreign manufacturer who exports to India is applying for a BIS certificate for import ,their firm has to be represented by their branch office in India, of any firm of Indian origin, preferably the brand owner of that product in India.

PROCEDURE OF BIS CERTIFICATION

Process for obtaining ISI mark for Indian ( online application ) and foreign manufactures ( offline application ) is as below:

  • Identifying the Indian Standard ( IS ) applicable on the product
  • Setting up of In-house lab as per the standard.
  • Creation of BIS portal.( in-case of Indian manufacturers.)
  • Getting the product tested as per ISS ( Indian Standard Specifications )
  • Filing of application with test report and other requisite documents.
  • Clearing of queries ( if any ) raised by BIS
  • Audit of the factory by a BIS officer allotted to the firm.
  • Sample testing in the in-house test lab.
  • Sealing of samples for re-verification by the officer during the audit. ( The applicant does not have to wait for this test report, as the test report is already submitted during the application, this sample is just for re-verification )
  • Completion of audit.
  • Grant of license.

Note: BIS conducts 4 surveillances annually on all manufacturers, the details are as below:

a.) Random market sample in done 2 times in a year,
b.) Random factory surveillances are conducted twice to check if all the formalities are met by the licensee.

Process for obtaining CRS registration for Indian and foreign manufacturers:

  • Creation of BIS portal.
  • Testing of samples as per BIS’ allocated Indian Standard ( IS )
  • Preparation of application documents
  • Filing of application
  • Clearing of queries ( if any )
  • Grant of registration.

BIS CERTIFICATION COST OR BIS CERTIFICATION FEE

BIS certificate fees depends on various factors such as product, Indian Standard ( IS ) applicable, Nature of the manufacturer ( Indian or overseas ), etc.

Fee structure for CRS registration:

1) Government fees : INR 53,000+GST@18% / test report ( Additional INR 20,000 for each test report in 1 application )
2) Testing charges : As per actuals ( As they vary on the basis of product and lab )

All Indian manufacturers whose products fall under the mandatory category as per BIS have to obtain BIS registration certificate. Through the process of BIS online registration , Indian as well as foreign manufacturers can apply for BIS certification in the schemes applicable to their products respectively.

Foreign manufacturers have to apply for the BIS mark on their products under the CRS registration scheme of ISI mark, whichever is applicable on their product. When obtaining a BIS certificate for import the foreign manufacturer has to assign an Authorized Indian Representative ( AIR ), who will correspond with BIS on the behalf of the manufacturer

BIS new registration under the CRS scheme is granted for 2 years and after that it can be renewed for upto 5 years by paying the requisite fees. BIS product certification under ISI scheme is generally granted for 1 or 2 years initially, and then it can be renewed for upto2 years on subsequent renewals ( Applicable to both Indian and Foreign Manufacturer ).

BIS certificate registration can be applied only and only by manufacturers either of Indian or foreign origin. Traders or importers cannot apply for BIS registration online or offline. BIS certification cost depends on the scale of the manufacturer, product, scheme of BIS applicable etc. For payment of government fee for BIS certificate online, the manufacturer must visit the BIS portal. BIS certificate fee structure provides certain relaxations to MSME’s and thus, keeps the cost of certification low for them.
